How Nextrade Beverages Pty Ltd collects, holds, uses and discloses personal information under the Privacy Act 1988 (Cth).
1. About this policy
Nextrade Beverages Pty Ltd ("Nextrade Beverages", "we", "us", "our") respects the privacy of the individuals we deal with. This policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act.
It applies to personal information we collect through this website at nextradebeveragestec.site, by email, and in the course of our beverage wholesale, import, storage and distribution business.
"Personal information" has the meaning given in the Privacy Act 1988 (Cth): information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true and whether or not it is recorded in a material form.
2. What personal information we collect
We collect only the personal information reasonably necessary for our business functions and activities. This is usually limited to business contact information. It may include:
- Identity and contact details — your name, the business you represent, your role, your email address and, where you provide one, a telephone number.
- Enquiry and order information — the products, volumes, delivery locations and commercial terms you discuss with us, and correspondence relating to them.
- Delivery information — site addresses, access instructions and the name of the person who receives or signs for a delivery.
- Supplier and account information — details needed to establish a trading account, including business registration details and the contact details of authorised personnel.
- Payment-related information — remittance references and account correspondence. We do not store full payment card numbers.
- Technical information — limited information generated when you visit this website, as described in section 6.
We do not seek to collect sensitive information as defined in the Privacy Act 1988 (Cth), and we ask that you do not send it to us.
3. How we collect personal information
Wherever it is reasonable and practicable, we collect personal information directly from you — when you email us, complete the enquiry form on our contact page, place or discuss an order, or open a trading account.
We may also collect personal information from third parties where that is necessary for our business, for example from a freight carrier arranging a delivery, from a supplier confirming a shipment, or from a publicly available business register. If we receive personal information about you that we did not solicit and could not lawfully have collected, we will deal with it as required by APP 4.
4. Why we collect, hold, use and disclose personal information
We handle personal information for the following purposes:
- To respond to enquiries and provide quotations;
- To supply, store, transport and deliver beverage products, and to coordinate import and export movements;
- To establish and administer trading accounts, invoicing and payment;
- To maintain product traceability, batch and delivery records;
- To manage complaints, product queries, returns and, if required, a product recall;
- To comply with our legal and regulatory obligations, including taxation, customs and food-related record-keeping requirements;
- To protect our lawful interests, including recovering debts and resolving disputes.
We will not use or disclose your personal information for a secondary purpose unless you would reasonably expect it, you have consented, or the use or disclosure is otherwise permitted or required by law.
Direct marketing. We may send trade-related information such as availability or pricing updates to business contacts who have dealt with us. Every such message includes a simple way to opt out, and you may also opt out at any time by emailing [email protected]. We do not sell or rent personal information to any third party for marketing.
5. Who we disclose personal information to
We may disclose personal information to:
- Freight carriers, couriers and logistics providers, so that goods can be delivered;
- Warehouse and storage providers holding stock on our behalf;
- Customs brokers and freight forwarders, for import and export movements;
- Suppliers and producers, where necessary to fulfil or investigate an order;
- Our professional advisers, including accountants, auditors, insurers and lawyers;
- Payment processors and financial institutions;
- Government agencies, regulators, courts or law enforcement, where disclosure is required or authorised by Australian law.
We require the service providers we engage to protect personal information and to use it only for the purpose for which it was disclosed to them.
6. Overseas disclosure
Because we coordinate the import and export of beverages, we may disclose limited business contact information — typically a name, business name, email address and delivery or collection details — to recipients outside Australia, such as overseas suppliers, buyers, freight forwarders and customs agents. The countries involved depend on the shipment concerned.
Some of our technical service providers, including our website hosting and email providers, may also store data on servers located outside Australia.
Before disclosing personal information overseas we take steps that are reasonable in the circumstances to ensure the overseas recipient does not breach the Australian Privacy Principles in relation to that information, as required by APP 8.
7. Our website, cookies and analytics
This website is a static site. It does not use advertising cookies, tracking pixels, social media widgets, third-party analytics scripts, or any external content delivery network.
Our hosting provider automatically records standard technical information in server logs when a page is requested — such as the IP address making the request, the date and time, the page requested, and the browser user-agent string. This information is used for security, availability and troubleshooting purposes.
The enquiry form on our contact page does not transmit anything to a server. It opens a message in your own email application, addressed to us, which you then choose to send or discard. If you send it, we receive the information by ordinary email.
You can configure your browser to refuse or delete cookies. Doing so will not affect your use of this website.
8. Data quality and security
We take reasonable steps to ensure that the personal information we collect, use and disclose is accurate, up to date, complete and relevant. Please tell us if your details change.
We also take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include restricting access to information to those who need it, using access-controlled business systems and accounts, and keeping physical records secure.
No method of transmission or storage is completely secure. In particular, information sent to us by unencrypted email travels over the internet at your own risk.
If we suffer a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner where required.
9. How long we keep information
We keep personal information only for as long as it is needed for the purposes described in this policy, or for as long as we are required to keep it by law. Records supporting taxation, customs and trading transactions are generally retained for at least seven years, consistent with Australian record-keeping obligations. Traceability records relating to a batch of product are retained for the period appropriate to that product.
When personal information is no longer needed for any purpose for which it may be used or disclosed, and we are not required by law to retain it, we take reasonable steps to destroy it or to ensure it is de-identified, in accordance with APP 11.2.
10. Accessing and correcting your information
Under APP 12 and APP 13 you may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
To make a request, email [email protected]. We may need to verify your identity before acting on the request. We will respond within a reasonable period, ordinarily within 30 days. Access is provided free of charge, although we may charge a reasonable cost-based fee for supplying the information in a particular form.
If we refuse a request for access or correction, we will tell you in writing why, and how you may complain about that decision.
11. Anonymity and pseudonymity
Under APP 2 you have the option of dealing with us anonymously or under a pseudonym where that is lawful and practicable. In practice this is rarely workable for a trade supply relationship, since we need identifiable details to quote, invoice and deliver, but you may make a general enquiry without providing your identity.
12. Complaints
If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information, please contact us first at [email protected] with the details of your concern. We will acknowledge your complaint, investigate it, and respond to you in writing, ordinarily within 30 days.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which oversees compliance with the Privacy Act 1988 (Cth). The OAIC can be contacted through its website at oaic.gov.au, by post at GPO Box 5218, Sydney NSW 2001, or by telephone on 1300 363 992.
13. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always published on this page, with the date it was last updated shown above. Material changes will be reflected here rather than notified individually.
